Our Philosophy and Commitments

JVD is committed to protecting your personal data and ensuring a high level of protection of your personal information in accordance with European Regulation 2016/679 and French Data Protection Law No. 78-17. Below, you will find our personal data protection policy, which explains in particular what personal data we collect, how it is processed and on what legal basis, how long it is stored, and your individual rights. We invite you to read it carefully.

This version of the personal data policy may be updated by us if necessary, and you will be informed accordingly.

JVD is the data controller of your personal information, and its contact details are as follows: 3, rue des Brèches, 44406 REZÉ. In this policy, JVD is referred to as “we” or “our.”

Your Personal Data and Their Collection by JVD

Your personal data may be collected during:

  • your visit to our website,
  • our exchanges,
  • our prospecting activities,
  • the formation or execution of our contracts.

We do not collect any data unnecessary for the processing purpose indicated at the time of collection, nor data prohibited by law or regulation. The collection of certain data may be mandatory or optional, and you will be informed of the mandatory information. Your personal data may also be collected by third-party service providers or partners, who undertake to comply with European and national regulations on personal data.

Our policy is not to transfer your data outside the European Union; should we exceptionally proceed with such a transfer, it would only take place to a country or an organization subject to an adequacy decision (Art. 45 GDPR) or offering appropriate and sufficient safeguards (Art. 46 GDPR). We do not make any automated decisions.

Management of personal data

Clients are informed of the regulations concerning marketing communications, the French law of 21 June 2014 on trust in the digital economy, the French Data Protection Act of 6 August 2004, and the General Data Protection Regulation (GDPR: no. 2016-679).

Data controller
The person responsible for processing personal data is JVD, represented by its president and legal representative.
As the data controller, JVD commits to complying with current legal requirements. In particular, JVD defines the purposes of its data processing activities, provides clear information to its prospects and clients when collecting their consent, and maintains a processing register that reflects actual practices.
Each time JVD processes personal data, it takes all reasonable measures to ensure that the data is accurate and relevant to the intended purposes.

Purpose of data collection
JVD may process all or part of the following data:
• to prevent and combat digital fraud (spamming, hacking): hardware used for browsing, IP address
• to improve website navigation: login and usage data
• to conduct optional satisfaction surveys on JVD: email address
• to carry out communication campaigns (SMS, email): phone number, email address
JVD does not sell your personal data, which are only used when necessary or for statistical and analytical purposes.

Your data may be used for:

  • responding to a request from an administrative or judicial authority, a law enforcement officer, a legal representative, or complying with a court decision;
  • ensuring compliance with our general terms and conditions of sale/service;
  • protecting our rights and/or seeking compensation for damages we may suffer or limiting their consequences;
  • preventing any action contrary to applicable laws, particularly in the context of fraud prevention.

We may also process your personal data for the following purposes:

  • Business relationship: Organization of contests, lotteries, promotional operations, etc. / Sending marketing campaigns by email, mail, or phone (including via a service provider)
  • Security: Protection of property and individuals, and security through video surveillance
  • Miscellaneous: Management of professional networks / Management of agendas / Electronic signature / Execution of legal or contractual guarantees

Right of access, rectification and objection
In accordance with European regulations, JVD users have the following rights:
• right of access (article 15 GDPR), rectification (article 16 GDPR), updating or completion of their data, right to block or erase their personal data (article 17 GDPR) when the data is inaccurate, incomplete, ambiguous, outdated or unlawfully collected, used, disclosed or stored
• right to withdraw consent at any time (article 13-2c GDPR)
• right to restrict processing (article 18 GDPR)
• right to object to processing (article 21 GDPR)
• right to data portability for data provided by the user, when processing is automated and based on consent or a contract (article 20 GDPR)
• right to define the fate of their data after death and to choose whether JVD may share this data with a third party designated by the user
If JVD is informed of a user’s death and has received no instructions, it commits to deleting the data unless retention is required for evidentiary or legal compliance purposes.
If a user wishes to know how JVD uses their personal data, request rectification, or object to processing, they can contact JVD in writing at the following email or postal address: JVD, 3 rue des Brèches – 44406 Rezé Cedex
In this case, the user must clearly identify themselves and indicate the data they wish to have corrected, updated or deleted, by including a copy of a valid ID (identity card or passport). Requests to delete personal data will be subject to legal obligations that may require JVD to retain or archive certain documents.
Users of the JVD website may also file a complaint with a supervisory authority, such as the CNIL (https://www.cnil.fr/en/complaints).

Non-disclosure of personal data
JVD will not process, host or transfer collected client data to any country outside the European Union or deemed “non-adequate” by the European Commission without first informing the client. However, JVD remains free to choose its technical and commercial subcontractors provided they offer sufficient guarantees regarding GDPR compliance.
JVD commits to taking all necessary precautions to ensure the security of the data and to prevent it from being disclosed to unauthorized parties.
If JVD becomes aware of an incident that affects the integrity or confidentiality of client information, it will promptly inform the client and outline the corrective measures taken.
JVD does not collect any “sensitive data”.
User data may be processed by JVD subsidiaries or subcontractors (service providers) solely for the purposes set out in this policy.
Within the limits of their respective responsibilities, the individuals most likely to access user data are the persons in charge of publishing content.

Types of data collected
For users of a JVD website, the following data are collected and stored for up to 60 months after the end of the contractual relationship:
First name, last name, postal address, phone number, email addresses.
JVD also collects browsing data to improve user experience and offer tailored advice: Google Analytics cookies. These are also retained for a maximum of 60 months after the end of the relationship.

Methods and Retention Periods of Data
We manage your personal data in three phases:

  • An active phase where the data is stored for the period indicated below in the “active” database: your personal data is then accessible only to persons with an operational need to access it in order to carry out the authorized processing.
  • An archiving phase (for an additional period beyond the active database retention) when a legitimate reason justifies it: your personal data is then archived with restricted access and for a limited duration.
  • A deletion or anonymization phase: at the end of the additional archiving period indicated below, your personal data is deleted or anonymized (so that it can no longer be considered personal data identifying you).

Your personal data is kept for as long as necessary for the purposes of processing, our customer relationship if applicable, and the performance of contracts, and within the limits specifically set by regulations. We may retain your personal data in an archived form for accounting, tax, or evidentiary purposes for the duration of the applicable statutory limitation periods.

As an example, we indicate below the retention periods applying to the following processing operations (subject to regulations imposing different retention periods):

JVD places particular importance on the protection of your personal data and ensures that it is processed in compliance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679) and applicable French legislation.

Transfer outside the EU
We do not transfer your personal data outside the European Union. If such a transfer were to occur, we would ensure that it is subject to appropriate safeguards, in accordance with the requirements of the GDPR.

Your rights
In accordance with applicable regulations, you have the following rights:

  • Right of access, rectification, and erasure of your data
  • Right to restriction of processing
  • Right to object to processing
  • Right to data portability
  • Right to withdraw your consent at any time, where processing is based on consent
  • Right to lodge a complaint with the CNIL

In such cases, your data will no longer be actively processed and cannot be modified during the exercise of this right. You also have the right to request human intervention: data controllers may use automated decision-making for the subscription or management of your contract. In this case, you may ask the Data Protection Officer what criteria were decisive in the decision.

Incident notification

Despite our best efforts, no method of transmission over the internet or electronic storage is entirely secure. We cannot therefore guarantee absolute security. If we become aware of a security breach, we will notify affected users so they can take appropriate action. Our incident notification procedures comply with legal requirements, whether national or European. We are committed to keeping our clients fully informed of any issues affecting the security of their accounts and to providing all necessary information to help them meet their own reporting obligations. No personal information of JVD website users is published without their knowledge, nor exchanged, transferred, assigned or sold to any third party in any format. Only in the event of a JVD acquisition would such data be transferred to the buyer, who would then be bound by the same obligations regarding the storage and modification of user data.

Security
To ensure the security and confidentiality of personal data, including health-related data, JVD uses protected networks with standard features such as firewalls, pseudonymization, encryption and passwords.
During personal data processing, JVD takes all reasonable steps to protect the data from loss, misuse, unauthorized access, disclosure, alteration or destruction.

Hyperlinks, “COOKIES” and Internet tags (“TAGS”)

The JVD website includes a number of hyperlinks to other websites, set up with JVD’s authorisation. However, JVD has no control over the content of the sites visited in this way and therefore accepts no responsibility for them.

Unless you choose to disable cookies, you agree to the website’s use of them. You may disable cookies at any time and free of charge, using the options described below. Please note that doing so may limit or prevent access to some or all of the services offered on the site.

INTERNET TAGS (“TAGS”)
JVD may occasionally use internet tags (also known as “tags”, action tags, single-pixel GIFs, clear GIFs, invisible GIFs and one-by-one GIFs) and deploy them via a web analytics partner, who may be located in a foreign country and thus store the corresponding data, including the user’s IP address.

These tags may be placed in both online ads that direct users to the site and on various pages of the website.

This technology allows JVD to evaluate visitors’ responses to the site and the effectiveness of its actions (for example, how many times a page is viewed and what information is accessed), as well as how the site is used.

The external service provider may collect information about visitors’ usage of this site and other websites, compile reports on site activity for JVD and provide other services related to the use of the website and the internet.

Governing law and jurisdiction

Any dispute related to the use of the JVD website is subject to French law.
Unless prohibited by law, exclusive jurisdiction is granted to the competent courts of the Nantes Commercial Court (RCS Nantes).
